Gazprom wages legal battle over gas transit problems

      RBC, 03.01.2009, Moscow 19:55:28.Gazprom is going to file a lawsuit with the Arbitration Institute of the Stockholm Chamber of Commerce to force Naftogaz of Ukraine to ensure unhindered transit of Russian gas through Ukrainian territory to Europe, Gazprom CEO Alexei Miller said in a statement today. The case will be filed in accordance with Gazprom's contract dated June 21, 2002, on the amount and terms of Russian gas transit through Ukraine to European consumers in 2003-2013.

      Gazprom will seek a court injunction banning Naftogaz of Ukraine from any actions aimed at reducing the amount of Russian gas transited to Europe, the statement says. "I have informed Russian President Dmitry Medvedev of our preparations for the lawsuit. All the necessary documents will be prepared and sent to Stockholm shortly," Miller stressed.

      Nikolai Dubik, the head of Gazprom's legal department, said today that European partners could sue Ukraine for breaching the Energy Charter Treaty. Ukraine is a party to the Charter, along with other consumers of Russian gas such as Germany, Italy, Hungary, Romania, and Slovakia.
